劳务人员管理制度
(一)务工人员招工制度
为了加强施工现场劳动用工的管理,维护企业和劳动者的合法权益,根据《中华人民劳动法》等有关法律规定,结合我公司实际情况制定本制度。
1、劳务的用工主体为项目子公司。
劳务公司对接项目子公司,进行劳务分包,劳务公司才能作为用工主体自行招用务工人员及进行劳务作业分包。
2、务工人员的招用,必须由劳务公司依法与务工人员签订劳动合同。
劳动合同必须明确规定工资支付标准、支付形式和支付时间等内容。
3、务工人员劳动合同的签订,被录用之日起十五天内与劳动者签订书面劳动合同,劳动合同签订后,务工人员应提供有效的身份证,专业资格证,学历证,暂住证等复印件(签订合同时必须提供原件备查),到公司统一备案。
4、招收范围:
熟练的技术操作工,有中、高级技能职称的操作工优先录用,特殊工种人员必须具备行业执业资格证。
年龄18~55岁,身体健康。
5、劳务分包:
必须发包给具有建筑劳务承包资质的企业,不得发包给无资质的组织和个人(包工头)。
6、合同期限:
务工人员固定期限合同最长不超过一年,以完成一定工作为期的劳动合同,起止时间必须明确具体,合同期满应及时办理手续,离开公司办理注销手续。
(二)施工现场务工人员管理制度
为了加强施工现场的管理,保障建设工程顺利进行,促进安全、文明施工,根据本公司的实际制定本制度。
1、项目经理是施工现场务工人员管理的直接责任人。
专业、劳务分包的务工人员由雇佣单位负责管理,但必须遵守总包单位的各项规章制度。
2、项目部根据施工现场的人数配置专、(兼)职劳务管理员,负责施工现场务工人员登记,建立动态管理台帐,督促检查施工现场务工人员劳动合同签订落实,负责施工现场考勤表、工资发放表,劳动合同等资料收集整理。
3、施工现场务工人员必须依法签订劳动合同,必须经过安全培训后方可上岗,新招的务工人员上岗前必须经过安全教育。
4、务工人员应积极参加项目部组织的民工学习,接受项目部有关质量、安全、文明施工、法制及治安管理等方面的教育培训。

5、务工人员自觉遵守安全生产、文明施工的管理规定及制定的门卫、宿舍、食堂等制度,严禁赌博、寻衅闹事、打架斗殴,恶意要讨工资的行为。
造成恶劣影响的人员酌情予以处理。
6、施工现场建立管理网络,逐级落实责任制,做到人员底数清,流动进出清。
(三)务工人员考勤制度
为了规范施工现场的管理,加强务工人员的劳动纪律,结合本公司的实际制定本制度。
1、考勤是发放工资的依据之一,公司必须指定专人负责。
2、各作业班组务工人员的考勤,由经济责任人指定或委托班组长负责,务工人员互相监督核对,经责任人审查确认后,原件在次月5日前交项目部财务入账,复制一份交劳务管理员留存供相关部门备查,
3、劳务分包项目考勤表由劳务公司负责填报,次月5日前必须报总包企业项目部劳务管理员汇总备查。
4、务工人员必须严格遵守项目部的劳动纪律,工作时间不迟到、早退,不得无故缺勤。
请病假、事假需办理请假手续,未经同意擅自休假按旷工处理,连续旷工七天或一年内累计旷工超过十五天的视为自行解除劳动合同处理。

5、施工现场的务工人员必须按入场的时间,真实姓名按实考勤,不得弄虚作假,故意伪造考勤表,虚报多报人数冒领工资款,经查实严厉处罚。
(四)劳动纠纷处理制度
为了维护企业和劳动者的合法权益,保障社会的稳定,结合公司实际制定本制度。
1、加强施工现场的务工人员的规范管理,尽可能减少和杜绝劳动纠纷。
深入了解务工人员的思想动态,及早发现纠纷的苗头和不稳定因素,把劳动纠纷消除在萌芽状态。
2、做好劳动纠纷预防工作,建立完善务工人员的管理台帐,即:
施工现场务工人员考勤表、工资发放表、务工人员情况登记表。
3、在施工现场醒目处位置张挂劳动纠纷投诉电话,告知接人姓名,确保投诉举报渠道畅通。
4、对投诉内容受理人员应做好记录,及时查明情况,迅速做出处理,防止事态扩大。
5、接到行业管理或相关部门投诉信息后,受理人应及时与当事人取得联系,查清劳动纠纷原因,做好协调处理工作,处理结果如实的反馈相关单位。
6、充分发挥企业的调解会作用,尽可能把劳动纠纷做到内部消化解决,努力构建和谐社会氛围。
