Inmanypartsofthelaborcontractthescopeofapplicationoflegislation,thefirstcontractualobligations,breachofcontractandcompensationprovisions,formofcontract,thecontractisinvalid,themainchangesandtheirconsequences,contractlifting,jointlyandseverallyliableforsuchissuestomakeupforthe"LaborLaw"lessthan,butstilltherearesomeflaws.Thedevelopmentof"LaborContractLaw",shouldbeabsorbedfromthelocallaborcontractreasonablelegislation,andtheseissuesforthedesignofacompletesystem.
ThelaborcontractsysteminChinaseconomicreformandlaborreform,animportantaspectofthesystem.Reformofthecomplexityandlong-term,thedecisiononthereformprocessofthebirthofthe"LaborLaw"(1994)cannotbeinthelaborcontractsystemindetailtheprovisions,onlyauthorizethelocalgovernment"inaccordancewiththisLawandtheactualsituationintheregion,theprovisionsofthelaborcontractsystem,theimplementationofthesesteps,theStateCouncilforrecord."Thus,manyprovincesandcitieshaveintroducedalaborcontractrulesandwaysinwhich"laborlaw"andtorefineandsupplementtheprovisions,somealsobrokethe"LaborLaw"requirements.Thisistheperiodoftransitionwherethesystemofinstitutionalcompetitionandinnovationanimportantmanifestationofthedevelopmentshouldbethe"LaborContractLaw,"animportantlegislativeresources.Thisarticleattemptstocompareandcommentontheexistinglocallaborcontractlegislation,whichtosomeextentmakeupforthe"LaborLaw"lessthan,butneededfurtherrefinementoftheissues.
First,the"LaborContractLaw,"thescopeofapplicationof
"LaborLaw"inArticle2:
"InthePeoplesRepublicofChinasenterprises,individualeconomicorganizations(hereinaftercollectivelyreferredtotheemployingunits)andtheformationoflaborrelationswithworkers,theapplicationofthisAct.Stateorgans,businessorganizations,socialgroupsandtoestablishtherelationshipbetweenthelaborcontractwithworkers,inaccordancewiththeimplementationofthisLaw."asaresultofthelaborcontractsystemandtheexpansionofthecoverageofthemaintypesofemploymentincreased,thelimitationsofthisprovisionbecomingincreasinglyprominent.Legislationinmanypartsofthelaborcontractsystemhasmadeabreakthroughinthescopeofapplicationoftheprovisionsare:
(1)thescopeoftheexpansionofthemainemployers.Beijing,Hunan,ShandongProvince,ZhejiangProvince,locallegislation,suchasprivatenon-enterpriseunitswillbeincorporatedintothemainscopeofemployment.
(2)theapplicationofaunifiedlogo."LaborLaw"insection2,paragraph1,to"establishaworkingrelationship",paragraph2,to"establisharelationshipbetweenthelaborcontract"asdefinedinthescopeofapplicationofthisLawshallbeasignofworkers.InShanghai,ZhejiangProvinceintheLegislativeCouncil,thesignshavebeenunifiedto"establishacontractualrelationshiportheformationoflabor."(3)appliestothesameextent."LaborLaw"insection2,paragraph1,the"applicationofthisAct"andinparagraph2"inaccordancewiththeimplementationofthisAct",meaningthattheprovisionsofparagraph1ofthelaborrelationswiththeprovisionsofparagraph2oftheapplicationoflaborrelationsinthe"laborlaw,"thedegreeofdifferenceinperception.InShanghai,Zhejiang,Guangdongandotherpartsofthelegislationonavarietyofuniformprovisionsontherelationshipbetweenthelaborcontractas"theapplicationofthisOrdinance(theprovisionsofway)",resultingintheabolitionoflaborrelationsinthedifferentapplicationoftheLaborCodeofthedegreeofdifference."ShenzhenSpecialEconomicZoneLaborContractRegulations"Article3ofthe"staff"isdefinedinreferencetotheenjoymentofcivilservantsorinadditiontothetreatmentofpersonsotherthancivilservantsoftheSARwithemployersrecruitstaff,to"employers"isdefinedintheSARrecruitstaffwithenterprises,stateorgans,institutions,socialorganizations,individualeconomicorganizations.Thisalsoshowsthattherelationshipbetweenthevariouslaborcontracts,whereapplicable,theextentoftheOrdinancewithoutthedifferences.(4)theincreaseinthetypeoflaborcontract."ShanghaiLaborContractRegulations"chapter-based(ChapterV)forpart-timelaborcontractspecificallyprovidedforthefirsttime,part-timelaborrelationswillbeincludedintheadjustmentofthescopeoflaborlaw.Thesebreakthroughs,toacertainextentadaptedtotheeconomicsystemreformandtheneedtoreformthelaborsystem.
Locallegislationonthelaborcontractsystemtodefinethescopeofapplicationisalsolessthanthefollowing:
(1)thescopeofemploymentasdefinedinthemainlackofflexibility.Withthedevelopmentofthemarketeconomy,newtypesofmarketplayershaveemerged,inordertogivefullplaytotheLaborContractLawonthelegalregulationoflaborrelationsfunctions,themainshouldbeacorrespondingexpansionofthescopeofemployment.However,theexistinglocallegislationwiththe"LaborLaw"asthemaintypeofemploymentonlyprovidesaclosedlist,althoughsomelocallegislationtoadda"privatenon-enterpriseunits",buthavenotyetbeenabletouseemergingthemaintypesoflaborcontractsarecoveredbythescopeofapplicationofthesystem.
(2)appliestoalackofintegrityofthechoiceofsigns.Accordingtothe"LaborLaw"Article19,LaborRelationsinwritingthattherelationshipbetweenlaborcontracts,didnotenterintoawrittenlaborcontractthatisnottoestablishtherelationshipbetweenthelaborcontract.Existinglocallegislationto"establishacontractualrelationshiportheformationoflabor"asdefinedinthelaborcontractsystemappliestothescopeofasymbolofworkers,whichwillbetherelationshipbetweenthelaborcontracthasnotyetbeenestablishedworkersinthelaborcontractsystemtoexcludefromthescopeofapplication,andThisisthe"LaborLaw"insection2,paragraph1,theprovisionsof[1]andthe"LaborLaw"appliestothefactthatthepracticeoflaborrelationsisnotidentical.
Basedontheaboveanalysis,Ibelievethat"LaborContractLaw"onthedefinitionofthescopeofapplicationshouldconsiderthefollowingquestions:
(1)Inordertoensurethatthe"LaborContractLaw,"thescopeofapplicationofthestabilityandadaptabilityshouldbethemaintypesofpeoplelistedasopen,Inadditiontothatlist,"LaborLaw"andtheexistinglocallaborcontractlawenterprises,individualeconomicorganizations,privatenon-enterpriseunits,nationalagencies,businessorganizations,socialgroups,butalsotoincreasetheprovisionsof"otherlawsandregulationsidentifiedinthemainemployment",makingiteasierforpeopletobethemainnaturalpersons,farmersandotheremergingintooneofthemainemployers.Noteinpassingthatthe"employer"to"usethemain"seemsmorescientific.
(2)thescopeoftheworkers,theprovision"shouldbesetuptoestablishlaborcontractsorlaborrelations,theapplicationofthislaw."(3)theextentapplicabletoallemployersandtheirworkersarethemainprovisionsof"theapplicationofthisAct",nolongerbe"inaccordancewiththeimplementationofthislaw"requirement.
Second,thepartiesenteredintolaborcontractsofthefirstphaseofcontractualobligations
Laborcontractsforthepartiestocontractualobligations,concernshavebeenanumberoflocallegislation.Beijing,Shanghai,Zhejiang,Shandong,Hunanandotherplacesofthefirstcontractprovidesthatthemainobligationsare:
(1)reporttoemployersemployingworkersinthatjobrequirements,jobcontent,workinghours,remuneration,workingconditions,socialinsurance,occupationalhazardsandtheirconsequences,andtreatmentofoccupationaldiseasespreventionandcontrolmeasures,regulationsandsoon.Hangzhou,ZhejiangProvince,andthelegislationalsorequestedthatthisdescriptionshallbeinwritingorstatedinthelaborcontract.
(2)enterintolaborcontracts,employerscannotseekanyformofimproperbenefittotheworkers,workersarenotallowedtocollectmortgagepayments,mortgage,depositorotherproperty,workersmaybeforcedtoraisecapitalinvestment,andworkersmaynotbeseizedidentitydocumentsandsoon.(3)theworkershouldreporttotheemployertoprovidemyIDcardandacademicqualifications,employmentstatus,workexperience,vocationalskills,suchasproofofhealthstatus.
Theexistingprovisionsoflocallegislationtherearealsoinadequate.Mainlyreflectedin:
(1)ofthefirstincompletecontractualobligations,mostofthisislimitedtotheobligationsofbothparties.
(2)didnotprovideforbreachofcontractualobligationstothelegalresponsibilitytoprotectcannotfulfillcontractualobligations,thecontractualobligationstobecomeemptywords.(3)isnotclearlydefinedthecourseofthecontractapplytotheprincipleofgoodfaithisnotconducivetothejudicialpracticeoftheexerciseofdiscretion.(4)thelaborcontractdoesnotguaranteethatthesystemcouldbeappliedtomakeitclearthatwhilethepracticeofemployingthemainrequirementsofsomeothersastheguarantorofworkers.(5)isnotreachedbetweenthetwosidescommittedtotheprovisionsofthelaborcontractenteredintoanagreement(forexample,theprocessofcollegegraduatesseekingjobsandemployersoftheemploymentagreemententeredintothemainbody)ofthebinding.
