GeneralConditions
TheShipyardTendermustspecifythetotalnumberofrunningdaysrequiredtocompletetheitemisedrepairsandfurnishindividualcostsforalltheitemsmentionedherein,tobequotedwiththesameitemnumbersandunitsasgiveninthisSpecification.
Additionallyitshallspecifythefollowing:
1.maxallowedtrimforenteringdry-dock,alsoadviseanydraftlimitations.
2.workinghoursoftheshipyard,normaltimeandovertimetimeasapplicabletoYards’tariffs.
3.costperhourforskilledtechnician.
4.localholidaysliabletoaffectShipyardlabourduringtheintendedrepairperiod
Thevesselistoenterdrydockonthedatestipulatedbytheshipyardanddelayinenteringnottoexceed1calendarday.Ifdelayexceedsone
(1)day,Ownerstohavetherighttocancelthecontract.
Thevesselwillproceedfromtheanchoragetotherepairberthandoncompletionofallrepairsandtestssailoutwardsusinghermainengine.
Allotherintermediateshiftingcostsincludingalltugs,pilot,shorelinesmen,etcwhicharefortheyard’sconvenience/repairprogram,aretobeattheshipyard’sexpenseandwithouttheuseofship’smainengine.
TheOwner/Owner’sRepresentativereservetherighttocancelanywork(asawholeorpartly)statedinthisspecificationwithoutanyadditionalcostimposedbytheyard/contractor.
TheShipyardwillberequiredtorenderadraftaccountatregularintervals.
TheOwnerwillconsiderinprivateallbidsreceivedandwillawardthecontracttothesuccessfulbidderattheOwnersconvenience.TheOwnerreservestherighttorejectanyandallbids.
TheShipyardTendermustcontainthefollowing:
“Weherebyagreetofaithfullycarryoutandcompleteallrepairs,renewalsandalterationstothem/v“ATROMITOS”andtoabidebyalltheconditionsexpressedorimpliedherein,forthesumandforthedurationquotedelsewhereinthisTender.”
Ifthetotalnumberofrunningdaysisexceeded,theshipyardshallpayapenaltyofUS$10,000(TenThousandUSDollars)perdayorfractionthereof,asliquidateddamages.
Termsofpaymentshouldbeclearlystatedwhichmustbecompetitivetoorbetterthatthoseprevailinginthemarketofyourarea.Thepaymenttermsmustbeagreeduponpriortovessel’senteringtheyard’spremises.
3.SpecificConditions
WorkmanshipandMaterials
Alllabour,materials(ifnotspecifiedasOwnersSupply),tools,staging,shores,lights,fans,foremen,supervision,labourers,insuranceetctobeincludedinthequotationunlessotherwisestated.
TheworkdescribedinthisSpecificationshallbecarriedoutinaccordancetogoodmarinepracticeandtothesatisfactionoftheOwnersRepresentativeandattendingclasssurveyorinaccordancewiththeRulesandregulationsofthevesselsclassificationSocietyandFlagadministration.
Allmaterialsandworkmanshiptobeoffirstclassqualityandofthesamestandardasappliedtothebuildingoftheshipandwith“ClassNK”Certificateasrequired.
TheOwnersRepresentativehastherighttorejectmaterialsand/orworkmanship.Suchdefectsshallbecorrectedbytheyardatnoadditionalcostordelaytotherepairschedule.
Noadditionalchargeshallbemadeforsuchworkandcostswhicharenecessaryofadirectconsequenceofcarryingoutthespecifiedworkirrespectiveofwhethertheyarementionedornotinthespecification.
Inspection
Aftercompletionofrepairworksoroverhauling,suchworkstobetestedasnecessaryandprovedingoodworkingordertotheOwnersSuperintendent’ssatisfaction.
Necessarycorrections,ifany,concerningthosepartswhicharerenewed,repairedordamagedduringthework,aretobemadegoodwithoutextracosttotheOwners.
AllteststobecarriedoutinthepresenceoftheOwnersRepresentativeandClassificationSocietySurveyorwhereconcerned.
AccesstoYardandShip
Duringthevessel’sstayattheshipyard,theOwnersRepresentativetohavetherighttoenterfreelyatallreasonabletimes,workshops,stores,officesoranyplaceintheshipyardwhereworkisbeingcarriedoutforaccountofthevessel.Thesameshallapplyinthecaseofsubcontractorsworkingonbehalfoftheyard.
TheShipyardistoallowSpecialistContractorsemployedbytheOwnersfreeaccesstothevessel,withoutanysurchargeonContractorsinvoice,includingThicknessMeasurementstechnicians.
Ship’spersonneltobepermittedtocarryoutroutinemaintenanceworks,whilstthevesselisattheshipyard.
Damages
Anydamagestothevesseland/orherequipmentcausedbyyard’semployeesoryard’ssub-contractorsshallberepairedbytheyard,freeofcost,totheOwnersandwithoutextralossoftimetothevessel.
AdditionalWorks
Anyordersinadditiontothisrepairspecification,beinggivenaftertheship’sarrivalandduringrepairs,tobeconfirmedbytheshipyardinwritingthenextday,statingthetimerequiredforsame.
Noextraworksbeyondthosestartedinthisspecificationwillbeundertakenbytheyard,unlesstheOwner’ssuperintendentengineerrequestssameinwriting.
Nodeparturefromthespecificationand/orapproveddrawingsistobemadebytheshipyard,withoutthewritteninstructionsfromtheOwnersRepresentative.
PeriodofRepair
Thetimerequiredforthecompletionofthestatedrepairsshouldbeincontinuousrunningdays.Thisshallincludethearrivalanddeparturedayfromtheyard.
ShipCleanliness
Oncompletionofrepair,allcompartmentstowhichtheyardhadaccessand/orcarriedoutwork/repairstobecleanedandalldebristobecollectedandremovedfromthevesselwithoutextracosttotheOwners.Itispreferablefordebrisfromrep
