TheConsumerFinancialProtectionBureau("theCFPB")isa21stcenturyagencythathelpsconsumerfinancemarketsworkbymakingrulesmoreeffective,byconsistentlyandfairlyenforcingthoserules,andbyempoweringconsumerstotakemorecontrolovertheireconomiclives.

Yet,priortoCongressenactingtheConsumerFinancialProtectionAct(CFPA)asTitleXofthe2010Dodd-FrankWallStreetReformandConsumerProtectionAct(PublicLaw111-203,datedJuly21,2010),consumerfinancialprotectionhadnotbeentheprimaryfocusofanyoneFederalagency,andnoagencyhadeffectivetoolstosettherulesforandoverseethewholemarket.Theresultwasasystemwithoutsufficientlyeffectiverulesorconsistentenforcementofthelaw.Theconsequencescanbeseen,bothinthe2008financialcrisisandinitsaftermath.
ConsumerfinancialprotectionistheCFPB’ssingularfocus.TheCFPAincreasedaccountabilityingovernmentbyconsolidatingconsumerfinancialprotectionauthoritiesthathadexistedacrosssevendifferentfederalagenciesintoone,theConsumerFinancialProtectionBureau.InadditiontoestablishingtheCFPB'senforcementpowers,theCFPAgivestheCFPBtheauthoritytosuperviseandexaminemanyfinancialinstitutionsthatwerenotpreviouslysubjecttoFederaloversight,suchasnonbankmortgagecompanies,paydaylenders,andprivateeducationlenders.Withtheconsolidationofexistingandnewfederalauthoritiesunderoneroof,theCFPBisnowproperlyfocusedandequippedtopreventfinancialharmtoconsumerswhilepromotingpracticesthatbenefitconsumersacrossfinancialinstitutions.

Industrystructureisalwayschanging,andtherefore,sotoowillthenumberofinstitutionsthatfallundertheCFPB’spurview.TheCFPBisdesignedtobeagileandadjustitsapproachtosupervisingthefinancialindustryinordertorapidlyrespondtochangingconsumerneeds.
HowtheCFPBaddressesnegativeexaminationfindingswilldepend,amongotherthings,ontheindividualfactsandcircumstancesatissue.Whetherinformalsupervisorymeasuresorformalenforcementactionisnecessarywilldependonthetypeofproblem(s)foundandtheseverityofharmtoconsumers,amongotherfactors.WhiletheCFPBaimstoresolveissuesthroughself-correction,somecircumstancesmayneverthelessbesufficientlyserioustowarrantapublicenforcementaction.
