依照《中华人民共和国合同法》、《上海市衡宇租赁条例》等相关法律法规
的规定,甲、乙两边经丙方居间介绍,在平等、志愿、公平和诚信的基础上,经协商一致,就乙方承租甲方的衡宇事宜,签定本合同,以资一起遵守:
ThisContractismadebyPartyCandbetweenbothpartiesafternegotiationonanequal,voluntary,fairandgood-faithbasisinaccordancewith“ContractLawofthePeople’sRepublicofChina”,“ShanghaiMunicipalityRegulationsontheLeasingofBuildingPremises”andotherrelevantlawsandregulations,withregardtotheissuethatPartyBwillrentthehouseofPartyA:
一、出租衡宇大体情形:
(下称“该衡宇”,实际情形以权属证明或相关法律文书的记载内容为准)

二、租赁用途
II.Usageoftherentedpremises
乙方向甲方许诺,租赁该衡宇作为(□居住□办公□生产□仓储□其他)利用,并遵守国家和本市有关于房地产利用和物业治理的规定。

三、交付日期和租赁期限

交付时甲、乙两边在丙方见证下签定本合同之附件二《衡宇交接书》。

四、租金、支付方式与支付日期

五、保证金(押金)和其他费用
V.Guaranteedeposit(securitydeposit)andotherfees
甲乙两边约定,在(□交房□签定本合同)时,乙方应向甲方支付衡宇租赁保证金(押金),保证金(押金)为个月的租金,即(□人民币□美元□)元(大写万仟佰拾元整)。
甲方收取该保证金(押金)后应向乙方出具收款凭证。
租赁关系终止时,甲方收取的衡宇租赁保证金(押金)除用于抵充本合同约定由乙方承担的费用外,剩余部份无息归还乙方。

租赁期间内发生的水费、电费、煤气费、(通信)费、电视收视费等衡宇利用费用由乙方承担;物业治理费由(□甲方□乙方)承担。

六、衡宇利用要求和维修责任
VI.Houseuserequirementsandmaintenanceresponsibility
租赁期间,乙方发觉该衡宇及其附属设施有损坏或故障时,应及时通知甲方修复;甲方应在接到乙方通知后的日内进行维修。
超期不维修的,乙方可代为维修,费用由甲方承担。
Duringtheleasingperiod,ifPartyBdiscoversanydamageortroublewiththepremisesandtheaccessoryfacilities,PartyBshalltimelynotifyPartyAforrepair;PartyAshallcarryouttherepairwithinday(s)afterreceivingthenotification.Incaseofdelayofrepair,PartyBmaymaketherepairinplaceofPartyAatthecostofPartyA.
租赁期间,乙方应合理利用并爱惜该衡宇及其附属设施。
因乙方利用不妥或不合理利用,致使该衡宇及其附属设施损坏或发生故障的,乙方应负责维修。
乙方拒不维修的,甲方可代为维修,费用由乙方承担。
Duringtheleasingperiod,PartyBshallmakereasonableuseofthepremisesandtheaccessoryfacilities.AnydamageortroublearisingfromimproperuseorunreasonableuseofthepremisesandaccessoryfacilitiesshallberepairedbyPartyB.IntheeventthatPartyBrefusestherepair,PartyAmaycarryouttherepairinplaceofPartyBatthecostofPartyB.
租赁期间,甲方应保证该衡宇及其附属设施处于正常的可利用和平安的状态。
甲方对该衡宇进行检查、养护,应提早日通知乙方。
检查养护时,乙方应予以配合。
甲方应减少对乙方利用该衡宇的阻碍。
Duringtheleasingperiod,PartyAshallensurenormalavailabilityandsafestatusofthepremisesandaccessoryfacilities.IfPartyAintendstocarryoutinspectionandmaintenanceonthepremises,PartyAshallnotifyPartyBdaysinadvance.Duringtheinspectionandmaintenance,PartyBshallprovidecoordination.PartyAshallminimizetheinfluenceontheuseofthepremises.
乙方需装修或增设附属设施和设备的,应事前征得甲方的书面同意,按规定须向有关部门报批的,那么应由(□甲方□甲方委托乙方)报请有关部门批准后,方可进行。
乙方增设的附属设施和设备的归属及其维修责任由甲、乙两边另行书面约定。
IncasethatPartyBintendstodecoratethepremisesoraddaccessoryfacilitiesandequipments,PartyBshallobtainwrittenpermissionfromPartyAinadvance;ifitisrequiredso,(□PartyA□PartyBentrustedbyPartyA)shallsubmitsuchbehaviortothecompetentdepartmentforapprovalbeforetheimplementation.TheownershipandmaintenanceoftheaccessoryfacilitiesandequipmentsaddedbyPartyBshallbeadditionallyagreedbybothpartiesinwrittenform.
七、衡宇返还与续租
VII.Housereturnandrentingrenewal
乙方应在本合同的租赁期限届满以后的日内返还该衡宇,未经甲方同意超期返还该衡宇的,每超期一日,乙方应以日租金的%向甲方支付该衡宇占用期间的利用费。
PartyBshallreturnthepremiseswithindaysaftertheterminationoftheleasingperiod,andincaseofanydelayforthereturnofthepremiseswithoutpermissionofPartyA,PartyBshallpayPartyAtheusefeeofthepremisesatthedailyrateequivalentto%ofdailyrentduringtheoccupationofthepremises.
乙方若是需要续租的,应在租赁期限届满两个月之前向甲方提出,甲方同意的,两边另行签定相关续租文书。
乙方在一样条件下享有优先承租权。
IncasethatPartyBwantstorenewtheContract,PartyBshallraisetherenewalintentiontoPartyAtwomonthsbeforetheterminationoftheleasingperiod,andwiththeapprovalofPartyA,therenewalcontractwillbeadditionallysignedbetweenbothparties.Undertheequivalentcondition,PartyBshallhavethepriorityforobtainingthelease.
租赁期限届满,甲乙两边未续签租赁合同,乙方继续支付租金,甲方未表示拒绝的,那么按法律相关规定,两边之间成立不按期租赁关系。
在不按期租赁关系中,甲方有权提早一个月通知乙方租赁关系终止。
Aftertheterminationoftheleasingperiod,ifnorenewalcontractissignedbybothpartiesandPartyBcontinuespayingtherent,whichisnotrefusedbyPartyA,thenon-fixed-termleasingrelationsareestablishedbetweenbothpartiesaccordingtorelevantlawsandregulations.Duringsuchnon-fixed-termleasingrelations,PartyAshallhavetherighttoterminatetheleasingrelationsbynotifyingPartyBone
(1)monthinadvance.
乙方返还该衡宇应符合正常利用后的状态。
返还时,应经甲方验收认可,并彼此结清各自应当承担的费用。
ThepremisesreturnedbyPartyBshallbeconsistentwiththestatusafternormaluseofthepremises.Uponreturnofthepremises,PartyBshallinspectthepremisesbeforeitsacceptanceandtherelevantfeesforrespectivepartiesshallbesettled.
八、转租与转让
VIII.Subleaseandtransfer
除甲方已经在本合同中同意乙方转租外,乙方在租赁期限内,需事前征得甲方的书面同意,方可将该衡宇部份或全数转租给他人。
但原始户型同一间居住衡宇,不得分割转租。
ExceptthatPartyAagreesinthisContractthatthepremisesmaybesubleasedbyPartyB,PartyBshallnotsubleasepartorallofthepremisestoanyotherpersonwithintheleasingperiod,withoutwrittenpermissionofPartyA.Anyhowonelivingroomintheoriginalhouseholdtypeshallnotbeseparatedforsubleasing.
在租赁期限内,甲方如需出售该衡宇,应提早两个月通知乙方。
乙方在签署本合同之时,已确认舍弃优先购买权。
Duringtheleasingperiod,ifPartyAwantstosellthepremises,PartyAshallnotifyPartyBtwo
(2)monthsinadvance.PartyBconfirmedthewaiverofthepreemptionofthepremisesatthetimeofsigningthisContract.
九、解除合同的条件
IX.Conditionsforcontractcancelation
甲乙两边同意在租赁期限内,有以下情形之一的,本合同终止,两边互不承担责任:
Bothpartiesagreethatduringtheleasingperiod,thisContractshallbeterminatedneitherpartyneedingtoassuminganyresponsibilityincaseofanyofthefollowingsituations;
(一)该房地产占用范围内的土地利用权依法提早收回的;
(1)Theuserightofthelandoccupiedbytherealestatehasbeenlegallyretrieved;
(二)该房地产因社会公共利益被依法征用的;
(2)Thepremisesareoccupie
